Anywhere Active LLC ("Anywhere Active," "we," "us," or "our") provides live virtual fitness and wellness classes, recorded classes, and related programming. Most people reach us through a library, parks and recreation department, or other organization that sponsors access for its community.
This policy explains what information we collect, how we use it, who we share it with, and what choices you have. It covers the Anywhere Active website and all Anywhere Active programs.
The short version: most people who use Anywhere Active never give us their name or email address. If you only watch recorded classes, and the organization sponsoring your access does not require registration, we do not know who you are. If you register for a class, we collect the small amount of information needed to send you reminders. If you attend a class shown in a room at a library or community center, we collect nothing about you at all.
Before classes are made available to you, our site shows a prompt that summarizes the key points of our User Terms and links to this policy, to those terms, and to our Group Viewing Terms. Selecting Continue accepts all three.
You may see that prompt again when you use a different device or return in a new session. If you do not want to accept, do not use the site.
Anywhere Active sets a standard for what we collect, and it is deliberately minimal. The organization sponsoring your access can choose to collect more.
A library, parks and recreation department, or other sponsoring organization may:
require registration before you can watch recorded classes, not only live ones;
add fields to the registration form, such as a library card number, a branch, ZIP code or location;
add its own questions to a feedback survey; and
apply its own privacy policy and its own records practices to the information it receives.
You will always be able to see what is being asked of you, because it is on the form in front of you. Where a sponsoring organization has added fields, we collect that information on that organization’s behalf, make it available to that organization, and do not use it for any purpose of our own beyond operating the service.
If you have questions about why a particular field is on a registration form, ask the organization that sponsors your access. It is their form.
If you watch recorded classes and are not asked to register, we do not collect your name, your email address, or any other information that identifies you personally. We do collect technical information automatically:
your internet protocol (IP) address;
session information, such as the pages you visit and the classes you view;
general information about your device and browser; and
information stored in cookies, described in Section 8.
We require three things: your first name, your last name, and your email address. That is all Anywhere Active asks for. Registration is always required for a live class, and is required for recorded classes at some organizations.
Registration must be completed by someone 18 years of age or older. An adult may register and then take part together with a child or other family members.
As described in Section 3, the organization sponsoring your access may add fields to the registration form. Anything additional is visible to you on the form when you fill it out.
We also keep a record of which classes you registered for and whether you attended.
After a class, people who registered may receive an email with a link to a short feedback survey. Taking it is optional. We collect whatever you choose to enter on the form, which is visible to you as you complete it, and we use it to improve our classes and to report on programming to the sponsoring organization.
Staff and administrators at sponsoring organizations are issued accounts. For account holders we collect the name, work email address, organization, and role associated with the account, along with login and activity records for the account. We may offer accounts to individuals in the future, and we will update this policy before doing so.
We collect nothing about you. If you walk into a room where an Anywhere Active class is being shown on a screen, you are not using our website, you are not asked to register, and no information about you reaches us. The organization hosting the room may keep its own attendance records under its own policies, and those records are not shared with us.
When someone accepts our User Terms through the prompt described in Section 2, we keep a record of that acceptance. The record includes the date and time, which version of each document was accepted, which organization’s page it happened on, the IP address, session and device or browser information, and the language displayed.
We keep these records because our terms include important health and safety information and a release of liability, and this is how we can show what a person was told and when. We keep them for seven years. This record is not used for marketing, is not combined with registration information to build a profile, and is not shared with sponsoring organizations.
Health information. Anywhere Active does not collect health information. We do not ask about medical conditions, injuries, medications, physical limitations, or fitness assessments, and we do not want that information. Our classes tell you to consult your doctor where appropriate, and that conversation stays between you and your doctor. As noted in Section 3, a sponsoring organization may add a confirmation field to its own registration form.
Payment information. We do not collect payment or credit card information from individual participants. Sponsoring organizations pay for the service, and individuals are not charged. If we ever offer paid access to individuals, we will update this policy first.
Video and audio of participants. Participant cameras and microphones are never enabled. See Section 7.
Precise location. We do not collect GPS or precise geolocation. An IP address gives only a general and often inaccurate indication of area.
We use the information we collect to:
deliver live classes and recorded content;
send reminders, calendar information, and confirmations for classes you registered for;
schedule and administer classes and programs;
run feedback surveys and evaluate our programming;
report participation levels and program results to the organization sponsoring your access;
operate, secure, troubleshoot, and improve the site;
send occasional updates about features and programming, which you can opt out of at any time;
keep records of acceptance of our terms, as described in Section 4.6; and
meet our legal obligations and enforce our agreements.
We do not use your information to build advertising profiles, and we do not use it for automated decisions that have any legal or similarly significant effect on you.
We use a small number of outside providers to run the service. They may process information on our behalf, only as needed to do their job for us, and under obligations of confidentiality. Our current providers include:
Email delivery. SendGrid and Mailgun, used to send class reminders, calendar information, and transactional messages.
Marketing messaging. Brevo, used to send programming updates to account holders and to people who have registered for classes.
Analytics. Google Analytics, used to understand how our site is used, such as which pages and classes people visit and how they move through the site.
Web hosting and infrastructure. Providers who host our website, application, and data.
Video streaming and delivery. Providers who deliver live classes and recorded video.
Business email. Google Workspace. If you email us, that message is handled in Gmail.
We may add or change providers. This list reflects our current providers and we will keep it reasonably current.
If you register for a class through a library, parks and recreation department, or other sponsoring organization, we make your registration information available to that organization. This includes your first and last name, your email address, anything additional its own form collected, the classes you registered for, whether you attended, and your registration history over time.
Sponsoring organizations use this to run their programming, understand what their community is using, report to their boards and funders, and communicate with participants about this and other programs. They may use it for any other lawful purpose.
Your information goes only to the organization you registered through. If you registered through Library A, Library A receives it. Library B does not, and neither does any other sponsoring organization.
Once a sponsoring organization has your information, its own privacy policy and records practices apply to what it does with it. If you want to know how your library handles it, ask the library.
Many libraries and public agencies are subject to laws that protect the confidentiality of patron and program records, and some are subject to public records laws. Where a law gives you or the sponsoring organization rights in this information that cannot be waived, those rights apply and we honor them. If we receive a legal demand for information about participants at a particular organization, we will notify that organization unless we are prohibited from doing so, so that it can assert any protection available to it.
We may use or disclose information if required by law, or where we reasonably believe it is necessary to comply with a law, court order, or legal process, to protect our rights, to protect your safety or the safety of others, or to investigate fraud or abuse of the service.
If Anywhere Active or its assets are acquired by another company, whether by merger, acquisition, bankruptcy, or otherwise, information we hold would transfer as part of that transaction. We will post a prominent notice on our website of any change in ownership or of material changes to how information is used, and will email registered participants and account holders where we have an address for them.
We do not sell your personal information for money, we do not rent or trade it, and we do not display advertising anywhere on the Anywhere Active site.
We do use a Google Analytics feature called Google Signals. When a visitor is signed in to a Google account and has turned on Ads Personalization with Google, Google Signals lets us see how that person uses our site across their devices, and gives us general information about the age ranges, interests, and locations of our visitors as a group. We use it to understand who our programming reaches and how to improve it.
Google Signals works through Google’s advertising infrastructure, which means information about your visit is shared with Google in a way Google may also use for its own advertising purposes. Some privacy laws treat that as sharing personal information for targeted advertising, or as a sale, even where no money changes hands and no advertising appears on our site. We want to describe it plainly rather than rely on the fact that we run no ads.
If you would rather your information not be used this way, you have several options:
decline analytics cookies in our cookie notice, which prevents the Google Analytics cookies from being set;
turn off Ads Personalization in your Google account settings, which stops Google from associating your activity with your account for this purpose across every site you visit, not only ours; or
install the Google Analytics opt-out browser add-on, which prevents Google Analytics from measuring your visits to any site.
We may share aggregate, de-identified information that does not identify anyone, for example the total number of people who attended a class or overall participation trends across our clients.
Your camera and microphone are never used. Anywhere Active does not enable participant cameras or microphones in live classes. Other participants cannot see or hear you, and you do not appear in any recording. Recordings capture the instructor and the instruction only.
Chat. Live classes may include a text chat you can use to send a message or question to the instructor. A name appears only if you choose to type one. Please do not enter personal information about yourself or anyone else. We keep chat content only for a short period after the class and then delete it.
We use cookies and session variables for essential functionality, to remember that you have accepted our terms during a session, to keep account holders signed in, and to understand how the site is used.
Some cookies are set by us, and some are set by services we use. Cookies set by another company are usually called third-party cookies.
Analytics. We use Google Analytics to understand how our site is used, for example which pages and classes people visit, how they arrived, and how they move through the site. Google Analytics sets its own cookies and receives technical information about your visit, including information about your device and browser. Google processes that information under its own privacy policy and its practices are not under our control. We use it only to understand and improve the service.
We also keep our own analytics. Some of the information described in Section 4.1 is recorded directly by our own systems rather than by an outside service.
Cross-device measurement. We have enabled a Google Analytics feature called Google Signals, described in Section 6.6. It draws on Google’s advertising infrastructure to show us how people use our site across devices and to give us general information about our audience. We use what it tells us to understand and improve our programming.
No advertising on our site. We do not display advertising anywhere on the Anywhere Active site and we do not sell advertising space. Section 6.6 explains what Google Signals means under privacy laws and how to opt out of it.
Session variables are deleted when you close your browser. Cookies expire after a set period. You can set your browser to accept or refuse cookies, and because that works differently in each browser you should check your browser’s help menu. If you refuse cookies, you can still use the site, though some functionality may not work.
Where required, we ask for your consent to non-essential cookies through a cookie notice on our site, and you can change your choice at any time. Analytics cookies are not essential, so where consent is required we do not set them until you have given it.
Our site includes links to other websites, and includes videos hosted on outside platforms that appear on our pages. Those platforms have their own privacy policies, which we do not control.
Embedded video is worth understanding. When a page containing an embedded video loads, your browser contacts the platform hosting that video. That platform may receive your IP address and may set its own identifiers, even if you never press play. This happens because of how embedding works, not because we send anything to them.
Our emails contain small invisible images, sometimes called pixels, web beacons, or clear gifs. They tell us whether an email was opened and whether a link in it was clicked, which helps us understand whether reminders are working and reach people who may have missed a class.
Because these emails go to a specific address, this information is linked to the person we sent it to. If you would rather not be tracked this way, most email programs let you block images from loading, and you can unsubscribe from non-essential messages at any time using the link at the bottom of any message.
How long we keep information depends on what it is.
Records of acceptance: seven years, for the reasons described in Section 4.6.
Live class chat: a short period after the class, then deleted.
Registration and participation information: while the sponsoring organization’s access is active and for a reasonable period afterward, so that programming can be reported on and continuity maintained. The sponsoring organization keeps its own copy under its own retention practices, and deleting information from our systems does not delete its copy.
Technical and analytics information: as long as needed for security, troubleshooting, and understanding site usage. Information held in Google Analytics is retained for the period set in our Analytics configuration.
Account information: while the account is active and for a reasonable period after it is closed.
We may keep information longer where we need it to comply with a legal obligation, resolve a dispute, or enforce our agreements. When we no longer need information, we delete it or remove what identifies you. Where neither is possible, we store it securely and isolate it from further use until deletion is possible.
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, or disclosure. These include encryption of data in transit, access controls limiting who on our team can reach participant information, restricting access to what a person needs to do their job, and reviewing our practices periodically.
No system is perfectly secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your information, we will notify affected individuals and sponsoring organizations as required by law and without unreasonable delay, and we will cooperate with sponsoring organizations in responding.
Wherever you live, you may ask us to:
tell you what information we hold about you and give you a copy;
correct information that is inaccurate;
delete your information;
restrict or object to how we process it;
provide it in a portable form; and
withdraw consent where we relied on your consent. Withdrawing consent does not affect processing we already carried out lawfully.
To make a request, use the contact form on our website. We will respond within a reasonable time, and in any event within the period required by any law that applies to you. We will not treat you differently for making a request.
Two practical notes. If you have never registered for a class, we usually have no way to connect our records to you, so there may be nothing for us to find, correct, or delete. And if you registered through a library or other organization, that organization holds its own copy of your registration information, so you may need to make a separate request to it.
If we cannot verify who you are, or if a law allows us to decline, we will explain why. Some state laws let you appeal a decision, and we will tell you how if that applies.
Registration is limited to adults. Only someone 18 or older may complete a registration form. This means children do not give us their names, email addresses, or any other personal information.
Children under 13. Anywhere Active does not knowingly collect personal information from children under 13, and our site is not directed to children. A child under 13 should use Anywhere Active only together with a parent, guardian, or other responsible adult, and should not register. If you believe a child under 13 has given us personal information, contact us through the contact form and we will delete it.
Ages 13 to 17. Someone between 13 and 17 may use Anywhere Active with the permission of a parent or guardian. A parent or guardian who permits this is responsible for supervising that use. Registration still needs to be completed by an adult.
Family classes. Some classes are designed for families to do together. These are meant for an adult taking part alongside a child, not for a child using the site alone.
Schools. Where a school shows a class to students in a classroom or gym, the school is using our site and the students are not. No student information reaches us. We do not collect student names or email addresses, and students should not be registering individually.
Anywhere Active is based in the United States and our services are intended for people in the United States and Canada. This section applies if you are in the European Economic Area, the United Kingdom, or Switzerland.
We rely on the following legal bases:
Contract. Where you register for a class, we process your name and email address in order to provide the class and the reminders you asked for.
Consent. Where you accept our terms, complete an optional feedback survey, opt into non-essential messages, or consent to non-essential cookies. You may withdraw consent at any time.
Legitimate interests. To operate, secure, and improve the service, to keep records of acceptance of our terms so that we can demonstrate what a participant was told, and to report participation to the organization sponsoring access. We balance these interests against your rights and privacy.
Legal obligation. Where the law requires us to keep or disclose information.
The Google Signals feature described in Section 6.6 is an advertising feature. If you are in the European Economic Area, the United Kingdom, or Switzerland, we do not enable it for you unless you have consented through our cookie notice, and you may withdraw that consent at any time.
You have the rights described in Section 13, and you may also lodge a complaint with your local data protection authority. We would appreciate the chance to address your concern first, through the contact form on our website.
Information we collect is processed in the United States, and some of our providers may process information elsewhere. Where information is transferred out of the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards, including the European Commission’s standard contractual clauses and the United Kingdom addendum to them, the EU-US Data Privacy Framework where a provider is certified under it, or another lawful transfer mechanism.
Anywhere Active serves library and organization partners in Canada as well as in the United States. This Section applies if you are in Canada.
We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act and, where it applies, provincial privacy legislation including Quebec’s Act respecting the protection of personal information in the private sector.
We collect, use, and disclose personal information with your knowledge and consent, and we limit what we collect to what is needed for the purposes described in this policy. You may withdraw your consent at any time, subject to legal and contractual restrictions, by contacting us through the contact form on our website. Withdrawing consent may mean we can no longer provide part of the service, for example reminders for a Class you registered for.
As described in Sections 6.6 and 8, we use Google Analytics with Google Signals, which measures activity across devices. You can turn this off using any of the methods listed in Section 6.6.
Your information is stored and processed in the United States, and some of our service providers may process it in other countries. While information is outside Canada it may be accessible to courts, law enforcement, and government authorities of those countries under their laws.
If a breach of our security safeguards creates a real risk of significant harm to you, we will report it to the Office of the Privacy Commissioner of Canada and, where required, to the Commission d’accès à l’information du Québec, and we will notify you.
You may ask us for access to your personal information, ask us to correct it, and, where the law provides for it, ask us to give it to you in a structured, commonly used technological format. Use the contact form on our website.
Anywhere Active has designated a person responsible for the protection of personal information. You can reach that person through the contact form on our website.
We store and process information on servers in the United States. Some of our service providers are located outside the United States or use infrastructure outside the United States, and information may be processed in those locations as part of providing the service. If you use the Services from Canada or from anywhere else outside the United States, your information will be sent to and handled in the United States.
We may update this policy from time to time. The current version is always posted on our website and identified by date and version. If we make a material change to how we use information, we will post a prominent notice on the site, and we will email registered participants and account holders where we have an address for them. We keep prior versions of this policy.
