These terms also reference our Privacy Policy, Business Terms, Participation Notice and Group Viewing Terms.
Anywhere Active LLC ("Anywhere Active," "we," "us," or "our") provides live virtual fitness and wellness classes, recorded classes, and related wellness programming. Most people reach Anywhere Active through a library, parks and recreation department, or other organization that sponsors access for its community.
These User Terms and Conditions (these "Terms") are an agreement between you and Anywhere Active LLC. They govern your use of the Anywhere Active website and services (the "Services") and your participation in any class ("Class").
There are three ways people use the Services, and these Terms cover all of them.
(a) Most people simply watch. You open the Services through your library's or organization's page, accept these Terms, and view a Class. You do not create an account and you do not give us your name or email address.
(b) Some people register for a Class. Registration is always required for a live Class. For a recorded Class, whether registration is required depends on the organization sponsoring your access. Registration asks for a name and email address, must be completed by someone 18 or older, and is not an account.
(c) Some people hold accounts. Staff at a sponsoring organization are issued accounts to administer that organization's programming. Anywhere Active may offer accounts to individuals in the future.
Separate Business and Organization Terms and Conditions govern the relationship between Anywhere Active and the organizations that sponsor access. Separate Group Viewing Terms govern showing a Class to a group of people gathered at a physical location. Both are published on our website.
Before Content is made available to you, the Services present a prompt that summarizes the most important points in these Terms and states that continuing means you accept them. The prompt links to these Terms, to our Privacy Policy, and to our Group Viewing Terms. By selecting Continue, you accept these Terms, including the release and assumption of risk in Section 3, together with the Privacy Policy and the Group Viewing Terms.
You may be asked to accept again when you use a different device or return in a new session. Each acceptance applies to your use of the Services in that session.
If you do not accept, do not use the Services.
If you accept while acting on behalf of an organization, including a library, senior center, school, or employer, you accept on behalf of that organization as well as yourself, and you confirm that you have authority to do so.
We keep a record of each acceptance, including the date and time, the version of each document you accepted, and technical information about the session. That record is how we demonstrate what you agreed to and when.
Please read this Section carefully. It affects your legal rights.
EXERCISE INVOLVES RISK
Physical exercise carries inherent risks. These include muscle, joint, and ligament injury, broken bones, falls, dizziness, fainting, aggravation of an existing condition, heart attack, stroke, other cardiovascular events, and in rare cases death. These risks cannot be eliminated, and some of them can occur even when a class is taught and performed correctly.
Anywhere Active instructors teach remotely over video. They cannot see you clearly, cannot assess your physical condition, cannot correct your form, and cannot reach you or give you any physical or medical assistance if something goes wrong where you are.
YOU ARE RESPONSIBLE FOR CHOOSING WHAT IS RIGHT FOR YOU
You decide which Classes to take and how far to go in them. Move at your own pace. Take a seated or easier option whenever one is offered. Skip anything that does not feel right. Stop immediately if you feel dizzy, faint, unwell, short of breath, or if anything hurts. If you believe you are having a medical emergency, call 911 or your local emergency number.
WHAT YOU AGREE TO
By accepting these Terms and by taking part in any Class, you agree that:
(a) you are taking part voluntarily and you knowingly and freely assume all risks of participation, both known and unknown, including the risks described above;
(b) you are responsible for determining whether any Class is appropriate for your own fitness level, physical condition, and health status, and for consulting a physician where appropriate;
(c) to the fullest extent permitted by law, you release, waive, and discharge Anywhere Active LLC, its affiliates, and their respective owners, officers, managers, employees, agents, contractors, and instructors (together, the "Released Parties") from all claims, demands, causes of action, and liability for any injury, illness, death, disability, or loss you may suffer arising out of or relating to your participation in any Class or your use of the Services, including claims based on the ordinary negligence of any Released Party; and
(d) you agree not to bring any claim against any Released Party that you have released under paragraph (c).
This release does not apply to gross negligence, recklessness, or intentional misconduct, and it does not apply to any liability that cannot be released under applicable law. It does not release any organization other than the Released Parties, including any library, senior center, school, employer, or other host of a physical location.
If you are under 18, you may not release claims on your own behalf, and nothing in this Section purports to release claims belonging to a minor.
Talk to your doctor first if you have a history of heart disease or high blood pressure, have experienced chest pain during or apart from exercise, smoke, have high cholesterol, are pregnant, have had recent surgery or injury, or have a bone, joint, or other condition that a change in physical activity could make worse. Do not use the Services if a physician or other healthcare provider advises against it.
The Services are general fitness and wellness programming. They are not medical care. Nothing available through the Services constitutes medical advice, diagnosis, or treatment, and nothing constitutes the practice of medicine, physical therapy, psychology, psychotherapy, or nutritional counseling. Anywhere Active instructors are fitness professionals engaged as independent contractors. They are not licensed medical providers.
Do not use anything you see or hear through the Services as a reason to change, delay, or stop medical treatment prescribed by a healthcare provider, and do not use it as a basis for self-treatment. Always seek the advice of your physician or another qualified health provider with any question about a medical condition or physical limitation.
Anywhere Active makes no representation or guarantee about fitness results, health outcomes, or the suitability of any Class for any individual.
You choose which Classes to take. To help you choose, Anywhere Active identifies for each Class whether it can be done seated, whether it includes standing, whether it includes floor work, and the general level of effort involved. Effort is described using a simple guide: at light effort you can talk and sing comfortably, at moderate effort you can talk but not sing, and at vigorous effort talking becomes difficult.
These descriptions tell you what the Class involves. They are not a statement that a Class is safe or suitable for you. Two people of the same age and general health can have very different capacities. You know your own body and your own limits, and you are the one deciding what to attempt on any given day.
The Services are designed for adults.
Children under 13. A child under 13 should use the Services only together with a parent, guardian, or other responsible adult, and should never register for a Class. Anywhere Active does not knowingly collect personal information from children under 13. Because registration is limited to individuals 18 and older, a child does not provide a name, email address, or other personal information to Anywhere Active. If you believe a child under 13 has provided personal information to us, contact us through the contact form on our website and we will delete it.
Ages 13 to 17. If you are between 13 and 17, you may use the Services with the permission of a parent or legal guardian. A parent or guardian who permits a minor to use the Services accepts these Terms on the minor's behalf and is responsible for supervising that use. As stated in Section 3, a minor cannot release claims, and we do not ask a minor to do so.
Registration. Registration for a Class must be completed by an individual 18 years of age or older. An adult may register and then take part together with a child or other family members.
Family and youth formats. Some Classes are designed for families to do together. These are intended for an adult participating alongside a child, not for a child using the Services alone.
Live Classes. Live Classes are scheduled in advance, often weeks or months ahead. Registration is required for every live Class, so that we can send you a reminder and calendar information and so that the organization sponsoring your access knows who is expected.
Recorded Classes. Whether registration is required to watch a recorded Class depends on the organization sponsoring your access. Some organizations require registration before you can watch a recording. Others let you watch without registering and without giving us any information about yourself. You will be asked to register at the point where registration is required, so you will always know which applies to you.
When you register we collect your name and email address. We use them to send you reminders and calendar information about the Class you registered for and to administer the program.
Your sponsoring organization can see your registration. The library, parks and recreation department, or other organization that sponsors your access has access to the names, email addresses, and registration information of people who register through its page, including registration history over time. Organizations use this to run and report on their programming. Their handling of that information is subject to their own policies and to any confidentiality obligations that apply to them.
Registration is not an account. There is no password and no profile, and you do not log in.
Your camera and microphone are not used. Anywhere Active does not enable participant cameras or microphones in live Classes. Other participants cannot see or hear you. You do not appear in any recording of a Class, and no recording includes participant video or audio.
Chat. Live Classes may include a text chat you can use to send a message or question to the instructor. A name is shown only if you choose to provide one. Please do not put personal information about yourself or anyone else into the chat. We keep chat content only for a short period after the Class and then delete it.
Live Classes are recorded so they can be added to the on-demand library. Recordings capture the instructor and the instructional content only.
Most people use the Services without an account. Where an account is issued to you, whether as staff of a sponsoring organization or under any individual account program Anywhere Active may offer in the future, the following applies.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You may not share your credentials with anyone, including a community organization that shows Classes at its own facility, and you may not assign or transfer your account. Notify us promptly through the contact form if you believe your account has been accessed without your authorization. Anywhere Active is not responsible for third-party access to your account resulting from theft or misappropriation of credentials.
Anywhere Active may refuse or cancel service, suspend or terminate an account, or remove or edit content at its discretion.
Sponsoring organizations may show Anywhere Active Classes to groups in their own spaces, and may invite community organizations such as senior centers, recreation centers, schools, and employers to do the same at their facilities. This is a valuable part of what Anywhere Active provides, and it is permitted under the Group Viewing Terms.
Showing a Class to a group of people gathered at a physical location is governed by the Group Viewing Terms, not by the personal use limitation in Section 12. Those terms set out what you may show, where you may show it, and what you are responsible for, including keeping the space safe, having a staff member on the premises, and posting the Participation Notice. Please read them before you show a Class to a group.
If you walk into a room where a Class is being shown, you are not required to create an account, accept these Terms, or sign anything, and these Terms do not apply to you.
The organization hosting that space runs the program. It controls the room, the equipment, and any supervision provided, and it is responsible for those things. Anywhere Active supplies the Class only. We have no presence at, control over, or ability to inspect or supervise any physical location, and we are not responsible for the condition or safety of a space in which a Class is shown.
The important safety information appears in the Participation Notice that the host organization posts in or near the room. It covers the same points as Section 3 and Section 4 of these Terms. Ask the host organization for a copy if you would like one.
Our Privacy Policy describes what information we collect, how we use it, and the choices available to you. It is posted on our website and forms part of these Terms.
In summary, what we collect depends on how you use the Services.
If you register for a Class, we collect your name and email address as described in Section 7. Registration is always required for a live Class, and is required for a recorded Class at some organizations.
If you watch a recorded Class without registering, we do not collect your name or your email address.
In either case, we collect technical information such as your internet protocol address, session data, and which Classes are viewed, and we use cookies as described in our cookie notice.
Anywhere Active grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms. Your license is for your own personal, non-commercial use, except that showing a Class to a group at a physical location is permitted where the Group Viewing Terms allow it.
You will not: (a) record, film, screen-capture, download, copy, rebroadcast, retransmit, or post any Class, except through a download function we expressly provide; (b) post or host any Class on any website, video platform, social media channel, or learning system; (c) charge any person any fee for access to, attendance at, or participation in a Class; (d) sell, rent, sublicense, or otherwise commercialize the Services or any Class; (e) modify, adapt, translate, reverse engineer, decompile, or create derivative works from any part of the Services; (f) remove or alter any copyright notice, credit, watermark, or branding; (g) use the Services in a way that damages, disables, overburdens, or impairs them, or that interferes with anyone else's use; (h) circumvent or attempt to circumvent any access control or usage limit; or (i) use the Services for any unlawful purpose or in a way that infringes anyone's rights.
The Services and their contents, including text, graphics, logos, images, Class recordings, live stream content, class descriptions, and the compilation and arrangement of all of it, together with the software used to operate the Services, are owned by Anywhere Active LLC or its licensors and are protected by copyright, trademark, and other laws. You acquire no ownership rights in any of it. You agree to observe all copyright and other proprietary notices and restrictions.
If you send us comments, feedback, questions, suggestions, or other materials ("User Content"), you grant Anywhere Active a worldwide, royalty-free, irrevocable license to use that User Content to operate and improve the Services and to respond to you. You are solely responsible for your User Content, and you agree not to submit anything unlawful, defamatory, obscene, fraudulent, infringing, or otherwise objectionable.
If you believe material available through the Services infringes your copyright, please send a notice through the contact form on our website, or to our designated copyright agent, including: identification of the work you claim is infringed; identification of the material you claim is infringing and where it is located; your contact information; a statement that you have a good faith belief the use is not authorized; a statement that the information in your notice is accurate and that you are authorized to act for the copyright owner; and your signature. We will respond to properly submitted notices and may remove material we believe in good faith to be infringing.
The Services may include links to other websites and video content hosted by third parties, including content embedded from third-party platforms. That content is not under our control. We provide it as a convenience, and its inclusion does not imply that we endorse it or are associated with whoever operates it. We are not responsible for the content of any linked site or embedded video, and your use of it is also governed by the terms of the platform hosting it.
Third-party content may not be shown to a group. Anywhere Active holds public performance rights only in the Classes it produces. Content produced by others and made available through the Services is for individual viewing only, and may not be displayed to a group of people gathered at a physical location. Where the Services do not identify a Class as cleared for group screening, treat it as not permitted for group screening.
Some functionality is delivered by third-party providers. By using that functionality you consent to our sharing information with those providers to the extent needed to deliver it.
Access is usually free to you. A library, parks and recreation department, or other sponsoring organization pays for the service and offers it to its community at no charge.
Anywhere Active may in the future introduce or change fees for parts of the Services or for different levels of access. We will give at least 30 days' notice before any fee applies to you, and you will be able to stop using the affected part of the Services rather than pay. Any optional specialty program with a fee will remain optional.
You may stop using the Services at any time. Anywhere Active may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, including where we believe you have breached these Terms. Sections 3, 4, 12, 13, 18, 19, 20, and 22 survive any termination.
THE SERVICES AND ALL CLASSES AND OTHER CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANYWHERE ACTIVE AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND INSTRUCTORS DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, THAT ANY DEFECT WILL BE CORRECTED, OR THAT ANY PARTICULAR CLASS, FORMAT, OR INSTRUCTOR WILL BE AVAILABLE OR WILL BE SUITABLE FOR ANY PARTICULAR PERSON.
The Services may contain inaccuracies or typographical errors, and we may change or improve the Services at any time. We may add, change, or remove Classes, formats, and instructors at any time and do not guarantee the continued availability of any of them.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANYWHERE ACTIVE, ITS AFFILIATES, AND THEIR RESPECTIVE OWNERS, OFFICERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, INSTRUCTORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY BODILY INJURY, ILLNESS, DEATH, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN ANY CLASS OR YOUR USE OF THE SERVICES, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY CLASS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID ANYWHERE ACTIVE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Nothing in this Section or in Section 3 excludes or limits liability for gross negligence, recklessness, or intentional misconduct, or any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so parts of this Section may not apply to you. In that case the exclusions and limitations apply to the fullest extent permitted.
If you are dissatisfied with the Services or with these Terms, your remedy is to stop using the Services.
You agree to indemnify, defend, and hold harmless Anywhere Active LLC, its officers, directors, employees, agents, instructors, and affiliates from and against any losses, costs, liabilities, and expenses, including reasonable attorneys' fees, relating to or arising out of: your use of or inability to use the Services; any User Content you submit; your breach of these Terms; your violation of any rights of a third party; or your violation of any applicable law, rule, or regulation.
Anywhere Active may, at its own cost, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
Anywhere Active may change these Terms from time to time. The current version is always posted on our website, and the version in effect when you accept is the version that applies to that use of the Services. When you next accept, the then-current version applies. We encourage you to review these Terms periodically. Each published version is identified by date and version number, and we retain prior versions.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Maryland for any dispute arising out of or relating to these Terms or the Services.
Before filing any claim, please contact us through the contact form on our website so that we can try to resolve the matter directly.
Using the Services and contacting us through the Services are electronic communications. You consent to receiving communications from us electronically, and you agree that any agreement, notice, disclosure, or other communication we provide electronically satisfies any legal requirement that it be in writing.
The Services are operated from the United States and are intended for users in the United States and Canada. If you access the Services from elsewhere, you do so on your own initiative and are responsible for compliance with local law. You will not use any Class in any country or in any manner prohibited by applicable law.
No joint venture, partnership, employment, or agency relationship exists between you and Anywhere Active as a result of these Terms or your use of the Services. Anywhere Active instructors are independent contractors of Anywhere Active.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible or, if it cannot be, replaced by a valid provision that most closely matches its intent, and the remainder of these Terms will continue in effect.
Our failure to enforce any provision is not a waiver of that provision or of any later breach.
These Terms, together with the Privacy Policy and, where applicable, the Group Viewing Terms, are the entire agreement between you and Anywhere Active with respect to the Services, and supersede all prior communications and proposals on that subject.
